1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts between Kevin Schweighofer, sole proprietor, (hereinafter referred to as "Seller") and his customers in connection with the sale of photo prints via his website.
1.2 Any deviating agreements require the written consent of the seller.

 

2. Conclusion of the contract
2.1 A contract is concluded as soon as the customer confirms an offer from the seller (e.g. by placing an order via the website or by e-mail) and the seller confirms this acceptance.
2.2 The seller reserves the right to refuse orders without giving reasons.

 

3. Products and Rights
3.1 The seller offers photo prints of his artistic works in various versions (e.g. with or without frame).
3.2 The sale is exclusively for private use of the purchased prints. Commercial use, reproduction, or distribution of the prints is prohibited.
3.3 All copyrights remain with the seller.

 

4. Delivery and Shipping
4.1 The printed products will be delivered to the address provided by the customer.
4.2 The customer shall bear the shipping costs unless expressly agreed otherwise.
4.3 The seller is not liable for delays, loss or damage caused by third parties during shipping.

 

5. Prices and Payment Terms
5.1 All prices are in euros (EUR) and do not include VAT, as the seller is a small business owner and does not charge VAT in accordance with §6 para. 1 no. 27 of the German VAT Act (if applicable).
5.2 Payment is due immediately upon completion of the order. Shipping will only take place after full payment has been received.

6. Right of withdrawal
6.1 Customers have the right to withdraw from the purchase within 14 days of receiving the goods, unless the products are custom-made or personalized.
6.2 The cancellation must be made by means of a clear declaration (e.g. by e-mail) to the seller.
6.3 In the event of a cancellation, the customer shall bear the costs of the return shipment.

 

7. Warranty and Liability
7.1 The seller is liable for defects in the delivered goods in accordance with statutory regulations.
7.2 The seller is not liable for minor deviations (e.g. color differences) that may occur due to technical limitations in the display.
7.3 Further liability claims, in particular for consequential damages, are excluded unless there is intent or gross negligence.

 

8. Data protection
8.1 The seller collects and processes the customer's personal data exclusively for processing the order and in accordance with applicable data protection laws.
8.2 Data will only be passed on to third parties if this is necessary for the processing of the contract (e.g. to shipping service providers).

9. Final Provisions
9.1 The law of the Republic of Austria applies.
9.2 The place of jurisdiction for all disputes arising from or in connection with this contract shall be the seller's place of residence or business, provided that this is legally permissible.
9.3 Should individual provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
